Welcome to Nibe Aeronautics Limited (“Company”, “we”, “our”, or “us”). These Terms & Conditions govern your use of our website (https://nibeaeronautics.com), our charter services, and any associated aviation operations. By booking a flight or utilizing our services, you (“Client”, “Passenger”, or “you”) agree to comply with and be bound by the following terms.

1. Flight Bookings & Operational Requirements

1.1 Provision of Information

To ensure seamless operations and to secure mandatory clearances from Air Traffic Control (ATC), Defense Authorities, and Civil Administration, the Client must provide all requested passenger details, manifests, and documentation within the stipulated timelines provided at the time of booking.

3. Cancellations & Flight Modifications

3.1 Cancellation Policy Schedule

Should the Client request a cancellation, the following charges will apply based on the scheduled departure time:

Due to verified Force Majeure 10% of the total invoice value ( Flight Preparation Charges )
More than 6 days prior to scheduled departure 25% of the total invoice value
Between 72 hours and 6 days prior to scheduled departure 50% of the total invoice value
Less than 72 hours prior to scheduled departure / No Show 100% of the total invoice value

3.2 Mid-Program Modifications

Any modifications or changes to the itinerary requested by the Client after the flight program has commenced are subject to operational feasibility, crew duty time limits, and regulatory permissions. If the requested changes cannot be executed due to these constraints, it will be treated as a last-minute cancellation, and a 100% cancellation fee will apply to the unexecuted sectors.

3.3 Diversions and En-Route Interruptions

If a flight must divert or return to the originating station due to sudden deterioration of weather, poor visibility, tactical defense operations, or ATC instructions, the actual flying time utilized and any associated landing/handling fees will be fully chargeable to the Client. Any remaining balance will be adjusted or refunded accordingly.

4. Passenger Check-In & Boarding Regulations

If passengers arrive late or request a last-minute departure delay, the Company will make reasonable operational efforts to secure revised airport slots. However, due to stringent airport slot allocations (especially at metro or defense airports), departure cannot be guaranteed. The Company disclaims all liability for consequential losses resulting from passenger-induced delays.

5. Baggage & Security Regulations

5.1 Baggage Allowance

Free baggage allowance is strictly subject to the aircraft's weight and balance limits, configuration, and the final passenger load factor. The definitive allowance will be specified in your flight quotation.

5.2 Prohibited & Dangerous Goods

For the safety of the aircraft and everyone on board, the carriage of Dangerous Goods is strictly forbidden in both checked and cabin baggage. This includes, but is not limited to:

Passengers are advised to carry high-value items, including currency, jewelry, negotiable instruments, and crucial identification documents, inside the cabin rather than in checked baggage.

7. Force Majeure

Nibe Aeronautics Limited shall not be held liable or responsible for any failure, interruption, or delay in performing its operational obligations if such issues arise from a Force Majeure event. This includes, but is not limited to: acts of God, extreme weather conditions, low runway visibility, sudden airport closures, regulatory restrictions or withdrawal of ATC permissions, military/defense activations, strikes, labor disputes, civil unrest, war, acts of terrorism, or unexpected technical snags that affect safety.

In the event of a total flight cancellation at the originating station due to Force Majeure, a refund will be issued to the Client, less any non-refundable actual costs already incurred (such as international permit or handling advance fees).

8. Governing Law & Jurisdiction

These Terms & Conditions shall be construed, interpreted, and governed in accordance with the laws of the Republic of India. Any disputes, differences, or claims arising out of or in connection with our services shall be subject to the exclusive jurisdiction of the competent courts in Pune, Maharashtra, India.
